Actions that Do Not Warrant Investigation

Many issues raised between registered users on AquaBid.com do NOT warrant investigation, nor will they be investigated if reported. These include, but are not limited to, breakdown in communication, misinterpretations, personal or private disputes or arguments. We have provided some examples for you, as well as some action you may be able to take to resolve the issues.

* Negative ratings or comments posted to a user rating profile, and removal of negative ratings or comments from a user rating profile.
Although it is frustrating and may seem unfair to have another user post negative user ratings or comments to your rating profile, AquaBid.com will not remove these comments, unless special circumstances exist. We do understand your disappointment with regard to receiving a negative rating or comment; however, you do have the option to post an answer on your profile to the negative ratings or comments left by other users. Please keep in mind, it is never acceptable to raise user rating profiles by posting positive ratings to your own profile or another. Please be aware, in consolation, that ratings and comments cannot be posted to a user rating profile without entering a valid transaction number first. This prevents abuse of our User Rating System. * The Seller is charging too much for shipping and handling or does not ship using a method that the Buyer agrees with; or

* The Seller requires that the Buyer pay in advance; use a method of payment that the Buyer does not have the ability to accommodate (i.e. credit card), etc.

* Every Seller has the right to choose the payment and shipment options that they will accept, provided that the methods they choose to utilize are posted with the item listing. If a Buyer does not want to purchase an item on the terms set forth by the Seller, revisions of the terms must be discussed with the Seller and agreed to by both parties before bidding on an item. If the Seller chooses to maintain their position regarding their terms (which is their right), the Buyer should not bid on the item if they do not wish to adhere to the original terms.

* The Buyer requests that the Seller ship the auctioned item COD, accept a third party check, ship items in a manner that is inconsistent with the Seller�s terms, etc.
For the Buyer to fail to complete a transaction with a Seller according to the agreed upon terms is considered Breach of Sale and is a violation of our policies. There are minor penalties such as warnings, or eventual account suspension for repeated offenses; however, AquaBid.com does not actually investigate these matters. Instead, a letter is forwarded to the offending party as a courtesy to the Seller. It is impossible for AquaBid.com to force a Buyer to actually complete a transaction with a Seller; however, the Seller does have the option to post negative ratings or comments to the violating Buyer�s rating profile. Additionally, the Seller has the option to re-list the item.

* The Seller does not respond to the Buyer�s initial contact email, sold the item to a Buyer other than the winning Buyer of the auction, or will not accept payment from a Buyer after the Buyer�s bid was accepted and the auction was ended.

AquaBid.com does not involve itself in any way in independent legal recourse initiated by users.

* Bid Subversion (out-bidding other bidders just before an auction ends)
Although it can be very disappointing for another user to out-bid you just before the end of an auction, it is not in violation of any posted AquaBid.com policies or rules.

* Anything that is not listed under Actions That Warrant Investigation By AquaBid.com.
